General Terms and Conditions of Sale (GTC)
Article 1 – Seller Designation
The website www.bacanaskincare.com is operated by Bacana Skincare, located at 2 Allee de Bordeneuve, Pibrac, France, and registered since September 2024 with the Toulouse Trade and Companies Register under the number 932 458 581.
Article 2 – General Provisions Relating to these General Terms and Conditions of Sale (“GTC”)
The GTC apply exclusively to online sales on the website www.bacanaskincare.com (“the site”). The GTC exclusively govern the online sales contracts of Bacana Skincare products (“the seller”) to buyers who qualify as consumers (“consumers”) and, together with the online order, constitute the contractual documents binding on the parties, to the exclusion of all other documents, brochures, catalogs, or product photographs, which are for indicative purposes only.
The GTC exclusively apply to products delivered to consumers located in France and/or in a member country of the European Union. The GTC are drafted along with all contractual information mentioned on the site in French, English, German, and Portuguese. The GTC are made available to consumers on the website www.bacanaskincare.com.
The GTC are enforceable against the consumer who acknowledges having read and accepted them before placing an order. The validation of the order by its confirmation constitutes acceptance by the buyer of the GTC in force on the day of the order. The seller ensures the retention and reproduction of the GTC.
These GTC were updated on 30/09/2024. Bacana Skincare reserves the right to modify its GTC at any time.
In case of modification of the GTC, the applicable GTC are those in force on the date of the order, of which a dated copy may be provided to the consumer upon request. The nullity of a contractual clause does not entail the nullity of the GTC. The temporary or permanent non-application of one or more clauses of the GTC by the seller does not constitute a waiver by the seller of the other clauses of the GTC, which continue to have effect.
Article 3 – Products
The products offered for sale presented on the site each have a description mentioning their essential characteristics within the meaning of Article L. 111-1 of the Consumer Code. The site offers various products for individuals, including cosmetic preparations. Bacana Skincare provides consumers with the necessary elements for the proper use of the products and cannot be held liable for damages caused by improper use of the products sold on its site or by non-compliance with usage precautions. The products are offered and delivered subject to availability. In case of unavailability of the ordered product, the seller will inform the buyer immediately and may offer a product of equivalent quality and price or, failing that, a gift voucher for the amount of the order, usable for any future order. In the event of disagreement from the buyer, the seller will refund the amounts paid within 5 working days.
The products sold on the site may not be resold or repackaged and resold without the written consent of Bacana Skincare.
Article 4 – Prices
The selling prices, in accordance with Article L. 112-1 of the Consumer Code, are indicated for each product in the electronic catalog in euros, all taxes included, excluding delivery and transport costs mentioned before the validation of the order and charged additionally.
The total amount due by the consumer is indicated on the order confirmation page.
The selling price of the product is that in effect on the day of the order.
The selling price of the products does not include shipping costs charged in addition to the price.
In case of promotional pricing, the seller commits to apply the promotional price to any order placed during the promotional period.
The seller reserves the right to change its prices at any time while guaranteeing the consumer the application of the price in effect on the day of the order. Additional transport, delivery, or postage costs, which the customer may have been informed of before the order, are specified on the order form.
Article 5 – Promotions
The promotions presented on the site are reserved for consumers residing in France and/or in a member country of the European Union and for deliveries in those same areas.
They are valid, unless indicated otherwise, as long as the products are listed in the electronic catalog and within the limits of available stock. The acceptance of the promotion by the consumer is validated, according to the double-click process, by the confirmation of the order.
Article 6 – Order
To place an order, the consumer, after filling their virtual cart by indicating the selected products and the desired quantities, then clicks on the “Order” button and provides the information related to delivery and payment method.
Before clicking the “Confirm Order” button, the consumer has the option to verify the details of their order and its total price and to return to previous pages to correct any possible errors or modify their order.
The confirmation of the order entails acceptance of the GTC and forms the contract.
An email acknowledging receipt of the order and its payment will be sent by the seller as soon as possible.
Any modification of the order by the consumer after confirmation is subject to the seller’s acceptance. The seller reserves the right to make modifications to the ordered product that are related to technical evolution in accordance with the provisions of Article R. 212-4 of the Consumer Code.
The seller reserves the right to refuse any order for legitimate reasons, particularly if the quantities of ordered products are abnormally high for buyers qualifying as consumers.
Article 7 – Contract
The sales contract is formed at the moment the consumer sends the confirmation of their order. The archiving of communications, order forms, and invoices is carried out on a reliable and durable medium in order to constitute a faithful and durable copy in accordance with Article 1360 of the Civil Code (formerly C. civ., art. 1348). These communications, order forms, and invoices may be produced as proof of the contract.
Article 8 – Payment
The price is due in full upon confirmation of the order. Payment is made immediately upon order by credit card, PayPal, or bank transfer.
Article 9 – Delivery
Delivery means the transfer to the consumer of physical possession of the goods. The seller will process the order as quickly as possible from Monday to Friday. Unless stated otherwise in the description of a selected product, delivery will be made within 5 working days, unless otherwise indicated on the site (e.g., exceptional closure for annual leave). In the case of payment by bank transfer or PayPal, this period begins to run the day after the payment order is issued.
The order is handed over to carriers (Chronospot, GLS, La Poste, etc.) for delivery within 2 to 4 days in metropolitan France and 3 to 5 days for other countries in the European Union. Delivery times vary according to the region or country of delivery.
In case of a delivery delay of more than 5 working days (i.e., for France: 3 days (preparation) + 3 days (transport) + a delay of 5 days), the customer must inform Bacana Skincare’s customer service, which will take the necessary and appropriate actions.
The products are delivered to the address indicated by the customer on the order form.
If the product is not compliant with the order, the consumer must send a complaint to the seller to obtain a replacement of the product or possibly the resolution of the sale.
Article 10 – Product Returns and Right of Withdrawal
If you are not satisfied with your purchase, you can return it for a full refund or credit. On this page, you will find more information about our return policy.
Return
All returns must be sent within thirty (30) days following the date of purchase. All returned items must be in relatively new condition. The content of the products must be relatively complete and must not have been used intensively.
Return Process
If you wish to return an item, please send an email to customer service at info@bacanaskincare.com, providing your purchase number and the reason for the return, in order to obtain formal authorization for the return. Securely place the item in its original packaging after receiving the authorization and return it to the following address:

Please note that you are responsible for return shipping costs. We strongly recommend using a tracked method for the return.
Refunds
After receiving your return and checking the condition of the item, we will process your refund. Please allow us 5 working days to process the request after receiving the merchandise. In the case of store credit, a voucher will be sent by email. In the case of a refund, we will credit back the payment method used to make the purchase. We will notify you by email as soon as your return has been processed.

Article 11 – Processing of Personal Data
Bacana Skincare processes information regarding consumers in accordance with its Privacy Policy.
Article 12 – Dispute Resolution
Bacana Skincare shall not be held liable for damages resulting from improper use of its products. In case of a dispute, our team is available via email (info@bacanaskincare.com) to attempt to resolve the dispute informally.
Article 13 – Applicable Law
This contract and the GTC governing it are subject to French law.
